Welcome to Rivva (“Rivva,” “we,” “our,” or “us”), operated by Baby.ai LLC. Rivva is a mobile application designed for caregivers to track baby-related activities such as feeding, diapers, sleep, growth, and health insights (the “Service”). By downloading, accessing, or using Rivva, you agree to these Terms of Use (“Terms”).

1. Eligibility

You must be at least 18 years old to use Rivva. By using Rivva, you confirm that you are the parent or legal guardian of the child whose data you track, or you have been authorized to enter such information.

2. Not Medical Advice

Rivva is not a medical device and does not provide medical advice, diagnosis, or treatment. AI-generated insights are informational only and may be inaccurate or incomplete. Always consult a licensed medical professional for clinical guidance. Do not rely on Rivva in emergencies.

3. User Accounts & Authentication

To create an account, you provide a mobile phone number or email address. Login is performed using one-time verification codes (SMS or email) or magic login links.

• We do not collect or store passwords.

• You agree to maintain control over your phone number or email access.

• You are responsible for actions taken through your account.

4. Acceptable Use

You agree not to:

• Use Rivva for illegal or harmful purposes

• Attempt unauthorized access or interfere with Service functionality

• Upload unlawful, offensive, or infringing content

• Reverse engineer, copy, or modify the Service or technology

We may suspend or terminate access for violations or for disruptive behavior.

5. Subscriptions & Billing

Some features require a paid subscription. Purchases are processed by the Apple App Store or Google Play Store, and store billing policies apply.

• Subscriptions automatically renew unless canceled through your store account.

• Fees are non-refundable except as required by law or platform rules.

6. Intellectual Property

All Rivva content, trademarks, designs, and software are owned by Baby.ai LLC or its licensors. You may use Rivva only for personal, non-commercial purposes. You may not reproduce or distribute without written permission.

7. AI Image Processing

Some Rivva features provide insights based on analysis of uploaded images (e.g., diaper or stool photos). When you upload an image:

• The image is securely transmitted to the Google Gemini API for processing.

• Baby.ai LLC does not run or train its own AI models.

• Baby.ai LLC does not permit AI training on submitted content.

• A reduced-size version of the image may be stored in your account so you can reference it later.

• Baby.ai LLC does not control how Google uses or stores images processed through the Gemini API. Please review Google’s privacy policy for details.

AI-generated insights are informational only and may be inaccurate.

8. Limitation of Liability

To the fullest extent permitted by law, Baby.ai LLC is not liable for:

• Errors, inaccuracies, or misinterpretations

• Decisions made based on Rivva data or AI insights

• Service interruptions or data loss

• Unauthorized access to accounts or content

Our total liability will not exceed the amount paid by you during the prior 12 months.

9. Termination

We may suspend or terminate access to the Service at any time. You may discontinue use at any time. Certain provisions (e.g., IP rights, liability limits) survive termination.

10. Changes to Terms

We may update these Terms periodically. Continued use after updates constitutes acceptance. We will notify users of material changes.

11. Governing Law

These Terms are governed by the laws of the State of California, excluding conflict-of-law rules.
